What to Expect


This page is to provide you with general information about the process that takes place when you contact the office.  The process may vary depending on the type of case and what the status of your case is when you contact the office, but for the most part this is what you can expect. To get started,  request a consultation!

 

Initial Consultation


The initial consultation is generally conducted in the office, but can also be conducted over the phone, if necessary.  The initial consultation is $325.00 and the appointment is scheduled for one (1) hour.  Once the initial consultation appointment is scheduled you will be sent an email confirming your appointment.  You will receive a separate email with a link to pay your invoice and a third email to complete your intake form.  The intake form can be completed and submitted electronically.  You will be asked to complete the intake form by 2:00 pm two (2) business days before your appointment.  You will also be asked to provide any related documents related to your matter in advance of your appointment.  You will receive one appointment reminder email 1-2 days before your appointment.

 

During the initial consultation, Attorney Gibbs, will obtain additional information regarding case.  You will be given an opportunity to ask questions.  Please be aware  you will only have one (1) hour for your appointment; Therefore, to make the most efficient use of your time at the office, have your most pressing questions written down so Attorney Gibbs, can provide you with general guidance based on the information you provide during the consultation.  Please bear in mind there may not be enough time to get to all of your questions.

 

Additionally, please keep in mind that each case is unique and has different factors that may impact the outcome; therefore, an answer to all of your questions may not be possible without additional information or research, which would be completed once you actually retain the office for representation in your case.  The information provided during the initial consultation is not intended to be nor should it be considered a final legal opinion on your case.

 

The initial consultation fee is $325.00.  You will be sent an invoice to make your payment, prior to your appointment.   If payment is not made at least 24 hours prior to your appointment, your appointment will be removed from the calendar and you will have to contact the office to reschedule.  If for some reason you are unable to keep your appointment, please be sure to contact the office to reschedule at least 24 hours prior to your appointment.

 

You can schedule your appointment for your initial consultation, during your case evaluation appointment and we encourage you to do so, to ensure you are able to secure an appointment and to ensure the office still has availability to accept your case, if the case load changes.

 

Business Services Meeting


This is a one-time complimentary meeting designed for business owners to meet the office staff, discuss the needs of the business with the attorney and the services the office can provide to support the business.  This meeting will also provide an opportunity for the business owner(s) and the attorney to get to know one another.  This is not appropriate for business owners that desire to ask legal questions.  This meeting is only to discuss the general business needs of the business and how the office can meet those needs.  This meeting can be conducted in the office or over the phone.  This meeting includes up to 30 minutes of time with the attorney complimentary.

 

Retaining the Office for Representation


If you decide to retain the office for representation, you and Attorney Gibbs will review and sign a letter of engagement or representation agreement (Agreement).  The Agreement will set forth the terms of the representation, whether it is for full representation or limited scope representation. It will also establish the firm’s duties and obligations under the agreement and the client’s duties and obligations under the agreement.  The office is not responsible or obligated to provide any services that are not specifically stated in the agreement.  Once the office has a signed agreement and the full amount of the deposit or fee, the representation begins and work will begin on your case.

 

In most hourly rate cases, you will be required to provide an upfront deposit.  The deposits range from $3,500.00 and can go up from there, depending on the facts of the case and the estimated amount of work that will be required.  The deposit amount required will be determined during the initial consultation and may be more or less than $3,500.00.    Please keep in mind the initial deposit requested and the estimated amount of work required, is only an estimate.  Your case may require more or less, which depends on a variety of factors, including the activities of the other party (opposing party) and any new developments in the case.

 

The upfront deposit, will be placed in a trust account.  Fees will be withdrawn from the deposit as the fees are earned.  If at the conclusion of your case, you still have a balance in the trust account, this amount will be refunded to you.  You will be kept informed of the status of your trust account balance via invoices in the client portal.

 

In most flat rate cases, the full amount is due up front and the fees are earned as stated in the agreement.  Payment plans are available on a case by case basis and is in the Attorney’s complete discretion.  Payment plans will require setting up automatic debits on the agreed upon dates, in most cases.

 

This office also provides general counsel services for our small businesses on an as needed basis.  Please contact the office for specific details on this service.

 

The Client Portal


Once your account and file is established in the firm, you will be set up on the client portal.  You will receive an email invitation to register your account.  You will need to create a user name and password.  From this client portal, you will be able to communicate with the firm, send and receive documents, pay your invoices, and verify appointments associated with your case.  The client portal provides a more secure environment for you to communicate and send information to the firm.

 

Your Attorney will use the client portal to send you messages and documents.   You can set up your account to send alerts to your email address when there is  new activity (i.e. new document uploaded, new message, new appointment) . You will want to sign in regularly  to receive updates on your case.

 

If you do not have an email account, reliable internet access, or you are otherwise unable to use the client portal. Please let the office know so we can use other  methods to communicate with you about your case.
